Terms of service
Kaizen Procurement Solutions SRL, a private limited liability company incorporated under Belgian law, with its registered office at Stedebouwstraat 62, 1083 Brussels (Belgium), and registered with the Cross-Bank for Enterprises under number 1020.560.655 (hereinafter referred to as "Origami Vintage"), operates an online boutique specializing in the sale of unique luxury vintage items and Japanese artisanal objects.
A Customer is defined as any natural or legal person entering into a contractual relationship of any kind with Origami Vintage. A Consumer refers to any person acquiring products exclusively for non-professional purposes. These terms apply to purchases made via www.origami-vintage.com (hereinafter referred to as the "Online Shop").
Article 1 – Products
The products offered are unique luxury vintage items, which may exhibit signs of wear attributable to their age; such characteristics do not constitute defects.
Each product undergoes a rigorous selection process, including specialized sourcing (particularly from Japan) and authenticity verification. Due to their rarity, products are available in limited quantities and cannot be replaced.
The products undergo a strict selection and control process, including authenticity verification based on the seller's internal expertise and, where applicable, that of specialized partners, particularly in Japan. The Customer acknowledges that this authentication relies on methods recognized within the luxury vintage sector, without the systematic provision of official certification.
Any dispute regarding the authenticity of a product must be raised within a reasonable timeframe following receipt and supported by serious independent expert opinion. Failing this, no claim shall be accepted.
Specificity of Japanese Art and Craftsmanship: The products offered may include works of art and Japanese craft objects selected for their authenticity, quality, and cultural value. These pieces, often handmade and stemming from traditional craftsmanship, possess a unique character and may exhibit irregularities, variations, or marks inherent to their artisanal production or age. These characteristics do not constitute defects but testify to their origin, history, and singularity. The Customer acknowledges and fully accepts these specificities upon purchase.
Article 2 – Applicability
2.1 Unless explicitly agreed otherwise in writing, these General Terms and Conditions apply to all purchases and orders placed via the Online Shop.
2.2 Placing an order on the Online Shop implies full knowledge and acceptance of Origami Vintage's General Terms and Conditions.
2.3 Origami Vintage reserves the right to modify these General Terms and Conditions at any time and without notice, in accordance with economic and legal necessities. Modified terms shall apply to any agreement concluded thereafter but shall in no way affect orders already confirmed by Origami Vintage.
Article 3 – Orders
3.1 The Online Shop contains precise descriptions and illustrations as accurate as possible of the products offered. Certain non-substantial characteristics of a product may, upon delivery, differ from the descriptions and illustrations displayed on the Online Shop. Colors may also vary slightly depending on lighting and computer screen settings.
As noted in Article 1, products are unique vintage items that may show signs of age-related use, which do not constitute defects. Each item undergoes rigorous selection, specialized sourcing (notably from Japan), and authenticity checks. Due to rarity, quantities are limited and replacement is impossible.
3.2 Origami Vintage is not bound by product descriptions clearly affected by error or mistake, such as obvious errors in pricing.
3.3 Products are available only within the limits of existing stock. In the event of exceptional unavailability after an order is placed (error, logistical incident), Origami Vintage will inform the Customer as soon as possible via email or telephone. The Customer shall then have the right to cancel the order against a refund. Origami Vintage shall not be held liable for damages resulting from temporary or permanent product unavailability. The seller's liability shall be limited to the refund of sums paid, excluding any other compensation.
3.4 Orders can only be processed if the Customer clearly identifies themselves by providing their address, email address, and billing details in the designated form. This information must always be up-to-date and truthful. Delivery shall be made in accordance with the form completed by the Customer.
Article 4 – Agreement
4.1 To conclude an agreement with Origami Vintage via the Online Shop, the following steps must be followed:
• The Customer adds the desired products to the cart and proceeds to checkout.
• If the Customer does not have an account on the Online Shop, they must fill in the address, email address, and billing information requested via the designated contact form to ensure delivery and invoicing.
• Once the required information is entered, the Customer selects the desired shipping method.
• The Customer then selects the desired payment method.
• The Customer confirms their acknowledgment and agreement with the General Terms and Conditions, which will be presented in PDF format with the option to download and save.
• The Customer confirms the order.
• The Customer is redirected to the website of Origami Vintage's payment service provider, depending on the chosen payment method, who will process the payment to Origami Vintage.
• Upon receipt of payment, Origami Vintage will confirm the order by email to the address provided by the Customer during the ordering process. At this stage, a binding agreement is formed between the Customer and Origami Vintage.
4.2 Origami Vintage and the Customer expressly agree that a binding agreement may be concluded by electronic means. The absence of a signature does not affect the binding force of the offer and its acceptance. Origami Vintage's electronic files serve as proof in this regard, to the extent permitted by law.
Article 5 – Right of Withdrawal
5.1 This Article 5 applies solely to Consumers placing an order via the Online Shop.
5.2 The Consumer may exercise their right of withdrawal within 14 (fourteen) days of delivery without giving any reason and without any penalty, provided that the product has only been unpacked to inspect it as would be possible in a physical store to decide whether to keep the product.
5.3 If the Consumer wishes to exercise their right of withdrawal, they must notify Origami Vintage using the standard withdrawal form available on the Online Shop, or by email to hello@origami-vintage.com, indicating the order number and the product(s) to be returned. Origami Vintage will evaluate the Consumer's request and provide further instructions for the return.
5.4 The product must then be returned to Origami Vintage within 14 (fourteen) days from the day the Consumer notified Origami Vintage of their decision to withdraw. The product must be returned in the same condition as received, taking into account return instructions. All elements (accessories), accompanying documents, and packaging materials must be included. If the Consumer fails to meet these conditions, Origami Vintage will refund the price of the returned products, reduced by associated costs.
Any returned product will undergo strict inspection by the seller. In case of deterioration, use, or alteration detected, the seller reserves the right to refuse the refund or apply a discount proportional to the depreciation observed.
5.5 The risk and burden of proof for the correct and timely exercise of the right of withdrawal rest with the Consumer.
5.6 Costs related to the return of the product(s) (including additional customs duties, taxes, customs fees, or similar charges) are borne by the Consumer.
5.7 Origami Vintage shall not be responsible for damage, theft, or loss of products resulting from the return of said products.
5.8 Provided the Consumer has exercised their right of withdrawal in accordance with the preceding paragraphs, Origami Vintage will refund the price paid by the Consumer (excluding, without doubt, costs related to the return of the products and, where applicable, costs related to any product damage) within 14 (fourteen) days of receiving the products by Origami Vintage, or, if earlier, after the Consumer has proven the products were returned. The refund shall be made using the same payment method used by the Consumer.
Article 6 – Prices
6.1 Prices indicated on the Online Shop include VAT. Origami Vintage has no control over duties, taxes, customs fees, or similar additional charges (which vary from country to country), which remain the sole responsibility of the Customer.
6.2 Prices do not include shipping costs. When the Customer chooses delivery, shipping costs are borne by the Customer. Shipping cost calculation is indicated at the time of purchase. The Customer acknowledges that choosing "express delivery" will incur additional costs.
6.3 Prices are expressed and all transactions are processed in Euros.
6.4 Except in case of error, prices will be charged as indicated at the time of the order. In case of a pricing error, Origami Vintage will inform the Customer by email within 30 (thirty) days following order confirmation. In such case, the Customer may choose to accept the new (correct) price or cancel the order and receive a refund of the amount already paid. In the absence of a response from the Customer within 7 (seven) days of notification, the order will be automatically cancelled.
6.5 Price indication refers exclusively to products as described textually. Accompanying illustrations are decorative and may contain elements not included in the price.
6.6 Origami Vintage may, at any time and without notice, adjust prices displayed on the Online Shop. However, a price adjustment will not be applied to orders already placed.
Article 7 – Payment
7.1 Unless otherwise agreed in writing, Origami Vintage invoices are payable immediately by bank transfer to Origami Vintage's bank account. Products will be shipped upon receipt of payment.
7.2 Payment must be made using one of the following methods (indicating associated costs):
• [Method 1]
• [Method 2]
The general terms and conditions of the "Shopify" payment systems apply according to the chosen payment method. If a credit card payment method is chosen, it is subject to the card issuer's conditions.
Article 8 – Delivery
8.1 Except in agreements with a Consumer, the delivery date indicated by Origami Vintage is always indicative. Any delivery delay cannot give rise to a right to any compensation from the Customer, a right to unilateral price reduction, nor a right to terminate the contract with Origami Vintage.
If Origami Vintage has concluded a contract with a Consumer, the specified delivery date is binding. In the absence of an agreed delivery date, a maximum delivery period of 30 (thirty) days applies from the day the order was confirmed by Origami Vintage.
In the event Origami Vintage fails to deliver the order within the agreed delivery period or the maximum 30-day period (in the absence of an agreed date), for any reason, the Consumer is entitled to request delivery within an additional appropriate timeframe or to cancel the order and receive a refund within 30 (thirty) days of notification of the paid price. If Origami Vintage fails to deliver within the agreed additional period, the Consumer shall have the right to cancel the order free of charge, without legal intervention, by simple notification, and receive a refund within 30 (thirty) days of notification.
8.2 Products will be delivered to the address specified in the contact form.
8.3 Delivery is deemed to occur when products are first offered at the specified delivery address and, in the case of a Consumer, when the Consumer physically takes possession of the products. In case of failed delivery due to the Customer's actions, all costs associated with new delivery attempts shall be borne by the Customer.
8.4 If multiple products are ordered, Origami Vintage reserves the right to deliver each product separately. However, Origami Vintage undertakes to make its best efforts to deliver multiple products in a single shipment.
8.5 The risk of loss or damage to products transfers to the Customer upon delivery.
Article 9 – Warranty and Claims
9.1 Origami Vintage guarantees that delivered products conform to the description and specifications indicated on the Online Shop, subject to the limitations set out in Article 2.1.
9.2 The Customer acknowledges that Origami Vintage sells second-hand products which may exhibit signs of use as described on the Online Shop through photographs and condition descriptions.
9.3 The Customer undertakes to inspect products immediately after delivery to verify conformity with the agreement and detect visible defects. Any non-conformity between agreed and delivered products, or any visible defect, must be communicated in writing to Origami Vintage without delay and at the latest within 8 (eight) days of delivery; failing this, the products shall be deemed accepted by the Customer.
9.4 Claims regarding hidden defects must be communicated to Origami Vintage by the Customer via registered letter at the latest within 2 (two) months of the discovery of such defects; failing this, the right to make such a claim shall be forfeited.
9.5 Claims regarding non-conformity in accordance with consumer legislation must be communicated by the Consumer to Origami Vintage via registered letter within 2 (two) months of discovery and at the latest within 1 (one) year of delivery; failing this, the right to make such a claim shall be forfeited.
9.6 Products undergo a rigorous selection and control process, including authenticity verification based on the seller's internal expertise and, where applicable, specialized partners, particularly in Japan. The Customer acknowledges that this authentication relies on methods recognized in the luxury vintage sector, without systematic official certification. Any dispute regarding authenticity must be raised within 8 (eight) days of receipt and supported by serious independent expert opinion. Otherwise, no claim will be accepted.
9.7 Complaints must be described in detail.
9.8 Recourse
9.8.1 In the event that products provided by Origami Vintage under the contract with the Customer present visible defects, or to the extent the Customer demonstrates that a non-conforming product was delivered, the Customer may only claim dissolution of the contract. Compensation may only be claimed if objectively demonstrable.
9.8.2 If the Customer demonstrates that the product concerns hidden defects known to Origami Vintage, the Customer may only claim a refund of the defective product's price after its return to Origami Vintage, or a price reduction. Compensation may only be claimed if objectively demonstrable.
9.8.3 In case of non-conformity under consumer legislation, the Consumer may demand a price reduction or dissolution of the contract and, where applicable, claim additional compensation if objectively demonstrable.
9.9 Claims regarding products modified by the Customer or a third party after delivery, or defects attributable to the Customer or a third party, will not be considered.
9.10 The Customer is obliged to allow Origami Vintage to investigate the claim and must therefore provide full cooperation.
9.11 Unconditional acceptance of products delivered by Origami Vintage shall be proven by the unconditional use of said products.
Article 10 – Data Protection
10.1 ORIGAMI VINTAGE will process all personal data received from the Customer in accordance with obligations regarding the processing of personal data, including Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
10.2 If the Customer wishes to obtain more information regarding data processing by Origami Vintage, they may contact Origami Vintage via email at hello@Origami-vintage.com or consult Origami Vintage's privacy policy on its website (https://origami-vintage.com/policies/privacy-policy).
Article 11 – Intellectual Property Rights
11.1 Origami Vintage retains all intellectual property rights on the Online Shop and all its components, including but not limited to all texts, images, layout, data, software, names, trademarks, labels, and logos, whether registered or not.
11.2 Neither the Online Shop itself nor the information offered therein may be stored, modified, published, distributed, transmitted, sold, transferred to third parties, or used in any form or manner whatsoever without the prior written consent of Origami Vintage.
Article 12 – Force Majeure
12.1 Neither party shall be held liable for any delay or failure to perform its obligations if such delay or failure is due to a force majeure event. The concerned party shall inform the other party within 7 (seven) days of the start of the force majeure event. A force majeure event is any cause beyond the reasonable control of that party preventing it from fulfilling its obligations under the agreement, temporarily or permanently, even if the cause was foreseeable. Without being exhaustive, a force majeure event includes: stockouts, third-party delays, defective machinery, strikes, lock-outs, fire, uprising, war, epidemic, flood, power, computer, internet, or telecommunications failures, and government decisions.
12.2 In case of force majeure, the execution of the concerned party's obligations is suspended. Both parties shall endeavor to limit the consequences of the force majeure event. If one party is unable to resume the execution of applicable obligations within 2 (two) months following notification of a force majeure event, the other party may terminate the agreement immediately, without compensation for either party, except for costs incurred by Origami Vintage before the force majeure event, which shall be borne by the Customer.
Article 13 – Liability
13.1 Except in cases of intentional fault or fault affecting the physical integrity of a person attributable to Origami Vintage or its executing agents:
• Origami Vintage shall never be held liable or obliged to compensate for immaterial, indirect, or consequential damages, including but not limited to loss of profit, loss of turnover, loss of revenue, loss of clientele, third-party claims, or any other form of damage;
• The total liability of Origami Vintage for direct damages shall at all times and without notice be limited to the price (VAT included) paid by the Customer for the product(s) under the corresponding order.
13.2 Origami Vintage shall not be liable for damages caused by errors due to third parties, the Customer, or force majeure cases.
13.3 Except for damages resulting from injury to physical or psychological integrity or damages resulting from intentional fault, Origami Vintage, its director(s), or employee(s) shall never be held extra-contractually liable for damages resulting from the breach of a contractual obligation that also constitutes an extra-contractual fault.
13.4 Origami Vintage shall never be held liable for monetary fluctuations.
Article 14 – Assignment
14.1 The Customer acknowledges that Origami Vintage may assign or subcontract its rights and/or obligations under the contract with the Customer.
14.2 The Customer is not authorized to assign or subcontract their rights and/or obligations under the contract with Origami Vintage to a third party without the prior written consent of Origami Vintage.
Article 15 – Non-Waiver
15.1 Waiver of any provision of these General Terms and Conditions shall only be effective if made in writing and signed by the other party.
15.2 Waiver of a specific provision of these General Terms and Conditions shall in no case be considered a waiver of any other provision, nor interpreted as a continuous waiver.
Article 16 – Severability
16.1 If any provision of these General Terms and Conditions is deemed illegal, invalid, or unenforceable, in whole or in part, under any applicable law, such provision or part thereof shall be deemed not to form part of these General Terms and Conditions, and the legality, validity, or enforceability of the remainder shall not be affected. Where necessary, the parties shall negotiate in good faith to replace the concerned provision with an enforceable, legal, and valid provision as close as possible to the intention of the original provision.
Article 17 – Applicable Law and Competent Jurisdiction
17.1 These General Terms and Conditions are governed by and interpreted in accordance with Belgian law.
17.2 The courts of Brussels shall have exclusive jurisdiction to hear any dispute arising from or relating to these General Terms and Conditions, unless mandatory law prescribes that such a dispute must be handled by another court.
